We advise shippers, receivers, carriers and insurers
on a full range of transportation issues that arise in the aviation,
marine, rail and trucking fields. We are routinely involved in cargo
claims litigation, as well as with product liability issues arising
from or being at the root of transportation casualties or losses.
We also provide advice on issues involving licensing, operating
authorities and public regulation.
In the aviation area we handle consumer issues and
complaints related to passenger air travel as well as cargo claims.
We provide advice regarding airfields and airports, aircraft personnel,
aircraft ownership and operation, and in the buying, leasing, and
selling of aircraft.
We handle all manner of marine issues and events:
ship collisions, property damage and personal injury claims arising
from small vessel and personal watercraft operation, resort and
lodge liability, salvage claims, pilotage issues, general average
claims, and equipment and manning issues. We also provide advice
concerning short sea shipping, port operations and related risk
management and intermodal interchange logistics. Our lawyers are
also experienced with charterparties and contracts of affreightment,
ship's mortgages and liens and related 'priority' disputes, in rem
claims against vessels and other maritime property, towage contracts,
the purchase and sale of vessels, and the management of and related
risk management of harbour docks and canals. We also provide advice
relating to marine transportation safety and security, coastal trading,
the transportation of dangerous goods and pollution.
On the rail side we advise on service complaints arising
in the rail industry, as well as disputes between railway companies
and other parties over railway infrastructure matters and commercial
matters such as demurrage disputes. We represent parties affected
by rail car derailments and involved in cargo damage claims arising
from rail transportation. We act for some short line rail carriers.
The firm represents a number of trucking companies
and their insurers in the litigation and resolution of casualty
and cargo claims. We have expertise in dealing with regulatory bodies
arising from the operation of transport trucks. This experience
extends to issues relating to operating authorities, 'safety record'
management and immigration and customs related matters pertaining
to the qualification of drivers and the domicile of equipment employed.
